15 February 2018

The Department of Health & Social Care has published its Summary of Responses to the Consultation on Introducing Fixed Recoverable Costs in Lower Value Clinical Negligence Claims.  In the conclusion the Secretary of State for Health accepts the proposal to set up a working group to develop a bespoke process for clinical negligence claims initially valued up to £25,000 and a grid of fixed recoverable costs for such cases.  The Civil Justice Council has already begun work to establish the working group who are expected to publish recommendations in Autumn 2018, which will be considered as quickly as possible by the Government.  The report can be found on our website or by using the follow link: FRC in Lower Value Clin Neg Claims - Consultation Summary
